1. Scope and Application

1.1

These General Terms and Conditions (“Terms”) apply to transport, freight forwarding and related logistics services provided or arranged under the Cargo Euro Hub brand by MB Baltic Moving Services (“Cargo Euro Hub”, “BMS”, “we”, “us” or “our”).

1.2

Our principal services include:

  • pallet transport;
  • groupage freight;
  • consolidated freight;
  • less-than-truckload transport (LTL);
  • part-load transport;
  • full-truckload transport (FTL);
  • dedicated van and dedicated vehicle transport;
  • parcel transport;
  • sea freight, including LCL and FCL services;
  • customs-related coordination;
  • temporary storage and terminal handling where required for transport; and
  • other freight forwarding and logistics services expressly agreed in writing.

1.3

Cargo Euro Hub is primarily a commercial freight and logistics service.

Services may be provided to companies, sole traders, organisations and other business customers.

Personal belongings and household effects may also be accepted in accordance with the special provisions set out in Section 15 of these Terms.

1.4

The specific transport order consists of these Terms together with the applicable:

  • quotation;
  • booking confirmation;
  • transport order;
  • invoice;
  • consignment note;
  • bill of lading;
  • carrier documentation; and
  • any additional written agreement between Cargo Euro Hub and the Customer.

Where a specific written booking confirmation expressly differs from these Terms, the specifically agreed provision shall prevail, except where mandatory law provides otherwise.

1.5

Mandatory provisions of Lithuanian law, European Union law, applicable national transport law and applicable international transport conventions take precedence over these Terms.

For international carriage of goods by road, the Convention on the Contract for the International Carriage of Goods by Road (“CMR”) applies where its conditions of application are met.

1.6

For business Customers, any terms and conditions supplied by the Customer shall not apply unless expressly accepted by Cargo Euro Hub in writing.

1.7

Where the Customer is a consumer, nothing in these Terms limits any mandatory rights that cannot lawfully be excluded or restricted.


2. Quotations and Formation of Contract

2.1

Requests for transport may be submitted through:

  • the Cargo Euro Hub website;
  • email;
  • telephone;
  • electronic messaging;
  • API or electronic integration where available; or
  • another method accepted by us.

2.2

The Customer must provide all information reasonably required to calculate and perform the transport.

This normally includes:

  • Customer or company name;
  • contact details;
  • collection country, postcode and address;
  • delivery country, postcode and address;
  • requested collection date;
  • description and nature of the cargo;
  • type of packaging;
  • quantity of pallets, packages, boxes or other units;
  • dimensions of each relevant transport unit;
  • weight per unit;
  • total weight;
  • loading metres where relevant;
  • whether loading or unloading assistance is required;
  • whether special equipment is required;
  • dangerous-goods information;
  • customs status where relevant; and
  • any special handling requirements.

2.3

A quotation is calculated on the basis of the information supplied by the Customer.

Unless expressly stated otherwise, a quotation does not constitute a guaranteed reservation of:

  • vehicle capacity;
  • container space;
  • ferry space;
  • vessel space;
  • warehouse space;
  • collection slot; or
  • subcontractor capacity.

2.4

A transport contract becomes binding when Cargo Euro Hub confirms the order in writing or otherwise expressly confirms acceptance of the booking.

Payment or advance payment may be required before the booking becomes effective.

2.5

Cargo Euro Hub may refuse an order before confirmation where, among other things:

  • suitable transport capacity is unavailable;
  • the information supplied is incomplete;
  • the goods cannot legally or safely be transported;
  • the proposed shipment creates an unreasonable operational risk;
  • the Customer has outstanding overdue payments;
  • sanctions or trade restrictions may apply; or
  • the service cannot reasonably be performed as requested.

3. Accuracy of Shipment Information

3.1

The Customer is responsible for ensuring that all information provided concerning the shipment is complete and accurate.

3.2

The actual cargo must correspond to the booking information, including:

  • number of units;
  • dimensions;
  • gross weight;
  • loading metres;
  • packaging type;
  • cargo description;
  • dangerous-goods status; and
  • customs information.

3.3

If the actual dimensions, weight, quantity, loading metres or nature of the goods differ from the information supplied when the quotation was issued, Cargo Euro Hub may:

  • recalculate the freight price;
  • invoice additional transport charges;
  • invoice third-party surcharges;
  • require a different vehicle;
  • require additional handling;
  • postpone collection;
  • refuse collection; or
  • cancel the transport where it cannot reasonably or legally be performed.

3.4

Where a shipment can still be transported but the price must be recalculated because incorrect measurements, weight or quantity were supplied, Cargo Euro Hub may additionally charge a €15 net administrative processing fee.

This does not limit our right to recover reasonable additional costs actually incurred.


4. Cancellation

4.1

Unless a quotation or booking confirmation states otherwise, a Customer may cancel a road freight booking without a cancellation charge when cancellation is received at least 24 hours before the scheduled collection time or collection window.

4.2

Where a pallet, groupage or standard LTL booking is cancelled less than 24 hours before scheduled collection, Cargo Euro Hub may charge a cancellation fee of up to 33% of the agreed freight price, reflecting transport capacity and costs already committed.

4.3

Where a dedicated vehicle, direct transport, part-load or FTL booking is cancelled less than 24 hours before scheduled collection, Cargo Euro Hub may charge up to 75% of the agreed freight price.

4.4

Where a vehicle has already been dispatched, capacity has been irreversibly committed, collection has failed because of circumstances attributable to the Customer, or third-party services have already become non-refundable, the Customer may be responsible for the reasonable costs actually incurred, which may amount to the full agreed freight price.

4.5

Cancellation charges for parcel services, sea freight, ferry bookings, customs services, port services, containers or other third-party services may be subject to the cancellation conditions of the relevant provider.

Non-refundable third-party costs remain payable by the Customer.

4.6

Cargo Euro Hub may cancel or suspend an order where:

  • the Customer has provided materially incorrect information;
  • required documents are missing;
  • the cargo is prohibited or undeclared dangerous cargo;
  • payment requirements have not been met;
  • performance would breach sanctions, customs rules or other legal requirements;
  • collection or delivery cannot safely be performed; or
  • circumstances outside our reasonable control make performance impossible or commercially unreasonable.

5. Dangerous, Prohibited and Restricted Goods

5.1

The following goods are not accepted unless Cargo Euro Hub expressly confirms their acceptance in writing and all legal requirements have been satisfied:

  • dangerous goods regulated under ADR, IMDG or other applicable dangerous-goods legislation;
  • explosives;
  • ammunition;
  • firearms and other weapons;
  • radioactive material;
  • infectious substances;
  • toxic or highly hazardous substances;
  • illegal narcotics or controlled substances;
  • goods whose possession, export, import or transport is prohibited;
  • waste requiring special permits;
  • live animals;
  • temperature-controlled or perishable goods unless expressly agreed;
  • cash;
  • negotiable securities;
  • precious metals;
  • loose precious stones;
  • alcoholic beverages;
  • tobacco products;
  • e-cigarettes and regulated vaping products; and
  • any cargo that creates an unreasonable risk to persons, vehicles, other cargo or property.

5.2

Lithium batteries, aerosols, chemicals, gas cylinders, fuels and other potentially dangerous articles must be disclosed before booking.

5.3

The Customer is responsible for correctly identifying, classifying, packaging, marking, labelling and documenting dangerous goods.

5.4

Where dangerous or prohibited goods are handed over without proper declaration, Cargo Euro Hub or the executing carrier may, where legally permitted:

  • refuse collection;
  • stop transportation;
  • unload the goods;
  • isolate the goods;
  • return the goods;
  • place the goods into appropriate storage;
  • notify competent authorities; or
  • take other measures reasonably necessary for safety or legal compliance.

5.5

The Customer is responsible, to the extent permitted by applicable law, for additional costs, penalties, losses and expenses resulting from incorrect or incomplete dangerous-goods information supplied by the Customer.


6. Transport Execution and Subcontractors

6.1

Cargo Euro Hub may perform the transport itself or engage third-party:

  • road carriers;
  • freight forwarders;
  • parcel carriers;
  • shipping lines;
  • container operators;
  • terminals;
  • warehouses;
  • customs representatives; and
  • other logistics service providers.

6.2

Cargo Euro Hub may select the route, carrier, vehicle, terminal, warehouse, shipping line, port and operational method reasonably considered appropriate for performance of the transport.

6.3

Unless direct or dedicated transport has expressly been confirmed, goods may be transported as part of a groupage or consolidated freight network.

6.4

Groupage and LTL shipments may involve:

  • consolidation;
  • deconsolidation;
  • terminal handling;
  • temporary storage;
  • cross-docking;
  • transfer between vehicles; and
  • multiple handling operations.

6.5

The use of subcontractors does not remove any liability that Cargo Euro Hub is required to retain under mandatory applicable law.

Where Cargo Euro Hub acts solely as an intermediary or agent for a particular service, the relevant third-party provider’s conditions may apply to that service where the Customer has been informed accordingly.


7. Customer Instructions

7.1

The Customer may provide reasonable instructions concerning performance of the transport.

7.2

Cargo Euro Hub is not required to follow instructions that are:

  • unlawful;
  • unsafe;
  • impossible;
  • inconsistent with transport regulations;
  • inconsistent with customs requirements;
  • materially different from the booked service; or
  • likely to cause unreasonable disruption to the transport operation.

7.3

Where new instructions result in additional distance, handling, waiting, storage, customs work or other expenses, such additional costs may be charged to the Customer.

7.4

Where a Customer insists upon a particular instruction after being informed of a relevant risk, Cargo Euro Hub shall not be responsible for loss or damage caused by that instruction to the extent permitted by applicable law.


8. Customer Obligations

8.1

The Customer must ensure that the goods are ready for collection at the agreed place and time.

8.2

Unless loading has expressly been included in the booking, the Customer is responsible for loading the goods onto the collecting vehicle.

Unless unloading has expressly been included, the consignee or Customer is responsible for unloading.

8.3

The Customer must ensure that loading and unloading can be performed safely and legally.

8.4

The Customer must provide all documents and information required for:

  • transportation;
  • customs clearance;
  • export;
  • import;
  • transit;
  • security procedures; and
  • other official formalities.

8.5

The Customer must ensure that the collection and delivery addresses are complete and accurate.

8.6

Unless otherwise agreed, collection and delivery locations must be reasonably accessible to the type of commercial vehicle required for the booked service.

The Customer must disclose any:

  • vehicle restrictions;
  • low bridges;
  • narrow roads;
  • pedestrian zones;
  • timed access restrictions;
  • loading bans;
  • gates;
  • security requirements; or
  • other circumstances affecting access.

8.7

The Customer must ensure that an authorised person is available to release the goods at collection and receive them at delivery.


9. Packaging and Labelling

9.1

Unless professional packing has expressly been included in the booking, the Customer is responsible for ensuring that the cargo is properly packed for the agreed mode of transport.

9.2

Packaging must be capable of withstanding the normal risks of the selected transport operation, including where applicable:

  • road vibration;
  • braking and acceleration;
  • stacking;
  • forklift handling;
  • pallet handling;
  • terminal handling;
  • consolidation;
  • transshipment;
  • temporary storage; and
  • multiple loading and unloading operations.

9.3

Palletised goods must be placed on a suitable pallet or other loading platform and must be sufficiently secured to prevent movement during ordinary transport.

Where appropriate, cargo should be secured using:

  • stretch film;
  • straps;
  • corner protection;
  • suitable boxes;
  • protective material; or
  • other appropriate securing methods.

9.4

A parcel must normally be fully enclosed in packaging suitable for parcel-network handling.

9.5

Cargo Euro Hub is not obliged to open packaging or inspect the contents of sealed packages.

9.6

We may refuse cargo where the packaging is obviously insufficient or creates a reasonable safety or damage risk.

Acceptance of cargo does not constitute confirmation that its packaging is sufficient for every risk of transport.

9.7

To the extent permitted by applicable law, Cargo Euro Hub shall not be liable for damage caused by inadequate or defective packaging for which the Customer or sender is responsible.


10. Collection, Delivery, Waiting Time and Failed Attempts

10.1

Collection and delivery dates and times are estimates unless a guaranteed time has expressly been confirmed in writing.

10.2

Estimated transit times are not guaranteed delivery deadlines.

10.3

Delays may occur because of:

  • traffic;
  • driver-hours restrictions;
  • terminal schedules;
  • ferry schedules;
  • weather;
  • customs;
  • border controls;
  • port congestion;
  • vessel schedules;
  • subcontractor schedules;
  • vehicle breakdown;
  • accidents; or
  • other operational circumstances.

10.4

For direct, dedicated, part-load and FTL transport, where waiting occurs at collection or delivery for reasons not attributable to Cargo Euro Hub or the executing carrier, the first two hours are normally free unless otherwise stated in the quotation.

After that period, a waiting charge of €80 net per started hour may apply.

Where the executing carrier’s unavoidable waiting charge is higher, the actual reasonable third-party charge may be passed on to the Customer.

10.5

If collection or delivery of a groupage or LTL shipment fails for reasons attributable to the Customer, sender or consignee, a second collection or delivery attempt may be charged at up to 33% of the original freight price, plus any storage or handling charges.

10.6

For dedicated, direct, part-load and FTL transport, a failed collection or delivery may result in a charge of up to 75% of the relevant freight price, depending on the costs incurred.

10.7

If redelivery is not possible and the goods must be returned to the sender or transported to another location, all reasonable additional transport, storage and handling costs are payable by the Customer.

10.8

Where goods cannot be delivered and must be held at a terminal or warehouse, storage and handling may be charged according to the tariff of the relevant warehouse, carrier or logistics provider.


11. Service-Specific Conditions

11.1 Pallet, Groupage and LTL

Pallet, groupage and LTL services normally involve consolidation and transshipment.

The Customer must package cargo accordingly.

Unless expressly agreed otherwise, such services do not constitute exclusive or dedicated use of a vehicle.

11.2 Part Load, FTL and Dedicated Transport

Where a dedicated or direct service has been confirmed, the booked vehicle or agreed vehicle capacity is allocated specifically to the relevant shipment.

Transshipment will normally not take place during direct road transport unless reasonably necessary because of:

  • accident;
  • breakdown;
  • legal requirements;
  • customs requirements;
  • safety reasons;
  • force majeure; or
  • another operational necessity required to complete the transport.

11.3 Parcel Services

Parcel services may be operationally performed by independent parcel carriers.

Their transport, packaging, size, weight, surcharge, claims and liability conditions may additionally apply.

11.4 Sea Freight

Sea freight may be performed as:

  • LCL;
  • FCL; or
  • another agreed maritime transport arrangement.

Sea freight may involve shipping lines, ports, terminals, customs operators and other third parties.

Sailing dates, vessel schedules and estimated arrival dates are not guaranteed unless expressly confirmed otherwise.

The Customer is responsible for costs attributable to the Customer or cargo that are not included in the agreed quotation, including where applicable:

  • demurrage;
  • detention;
  • port storage;
  • customs inspections;
  • container inspection;
  • container cleaning;
  • container damage attributable to the cargo or Customer;
  • port handling;
  • customs duties; and
  • other destination or origin charges.

The applicable bill of lading, sea waybill, shipping-line conditions and mandatory maritime law may apply to the sea-carriage portion of the service.

11.5 Pallet Exchange

Euro-pallet or other pallet exchange is not included automatically.

A pallet exchange obligation exists only where expressly confirmed in writing.

Where pallet exchange has been agreed but equivalent pallets are not supplied at collection or delivery, replacement or recovery costs may be charged.


12. Prices, Invoicing and Payment

12.1

Unless stated otherwise, prices are quoted in euros (EUR).

12.2

For business Customers, prices may be stated excluding VAT.

Applicable VAT will be added where required by law.

For consumers, mandatory price-display requirements remain unaffected.

12.3

A quotation includes only the services expressly described in it.

Unless expressly included, the price does not include additional costs such as:

  • customs duties;
  • import taxes;
  • export taxes;
  • customs inspections;
  • special permits;
  • storage caused by delays;
  • demurrage;
  • detention;
  • additional loading or unloading;
  • waiting beyond the included period;
  • redelivery;
  • return transport;
  • special lifting equipment; or
  • other charges resulting from circumstances not included in the original booking information.

12.4

Invoices may be issued electronically.

12.5

Unless the invoice or booking confirmation states another payment deadline, payment is due within two calendar days from the invoice date.

Cargo Euro Hub may require:

  • full prepayment;
  • partial advance payment;
  • payment before collection; or
  • payment before final delivery.

12.6

Where payment is overdue, Cargo Euro Hub may suspend further performance to the extent permitted by applicable law.

12.7

Statutory interest and legally recoverable collection costs may be charged on overdue commercial debts.


13. Liability

13.1 International Road Transport

Where the CMR Convention applies, liability for loss, damage and delay is governed by the CMR Convention.

Nothing in these Terms is intended to exclude or alter mandatory CMR provisions.

13.2

Under the CMR regime, carrier liability for loss or damage is generally subject to the compensation limits established by the Convention, including the applicable SDR-per-kilogram limitation, except where mandatory provisions provide otherwise.

Carrier liability must not be confused with full replacement-value cargo insurance.

13.3 National Transport

Where transport is performed entirely within one country and the CMR Convention does not apply, liability may be governed by the mandatory transport law of that country.

13.4 Freight Forwarding

Where Cargo Euro Hub acts as a freight forwarder, liability is also subject to the applicable provisions of Lithuanian law governing freight forwarding, together with any mandatory rules applicable to the underlying mode of transport.

13.5 Customer-Caused Risks

To the fullest extent permitted by applicable law, Cargo Euro Hub is not liable for loss, damage, additional expenses or delay insofar as they result from:

  • incorrect instructions supplied by the Customer;
  • incorrect shipment information;
  • inadequate packaging;
  • inadequate labelling;
  • loading or unloading performed by the Customer, sender or consignee;
  • inherent characteristics of the goods;
  • undisclosed dangerous goods;
  • customs documents supplied incorrectly or too late;
  • prohibited goods; or
  • circumstances for which the Customer is legally responsible.

13.6 Indirect Loss

For business Customers and to the extent permitted by law, Cargo Euro Hub shall not be liable for indirect or consequential commercial losses including:

  • loss of profit;
  • loss of market;
  • loss of production;
  • loss of contract;
  • business interruption; or
  • reputational loss,

unless such liability cannot legally be excluded.

13.7

Nothing in these Terms excludes liability where exclusion or limitation is prohibited by mandatory applicable law.


14. Cargo Insurance

14.1

Standard carrier or freight-forwarder liability is not cargo insurance and must not be understood as full replacement-value protection.

14.2

Unless expressly confirmed otherwise in writing, the freight price does not include separate All-Risk, full-value or replacement-value cargo insurance.

14.3

Customers who require protection above statutory carrier-liability limits should obtain appropriate cargo insurance before transportation begins.


15. Personal Belongings and Household Effects

15.1 Acceptance

Cargo Euro Hub may accept personal belongings and household effects where the shipment has been expressly approved.

Acceptance of personal belongings does not transform Cargo Euro Hub into a household removals insurer or insurance provider.

15.2 No Insurance Provided by Cargo Euro Hub

Cargo Euro Hub and MB Baltic Moving Services do not provide, sell, broker, arrange or underwrite insurance for personal belongings or household effects.

The transport price does not include:

  • household-goods insurance;
  • removals insurance;
  • All-Risk insurance;
  • replacement-value insurance; or
  • any other separate cargo insurance policy for personal belongings.

Any carrier or freight-forwarder liability arising under applicable law is not an insurance policy and should not be understood as full-value insurance.

15.3 Customer’s Independent Insurance

Customers transporting personal belongings are responsible for deciding whether additional insurance is required.

The Customer may independently purchase suitable transit, removals or household-goods insurance directly from an insurance company or authorised insurance broker before packing, collection or transport begins.

Any insurance contract is concluded directly between the Customer and the relevant insurer or broker.

Cargo Euro Hub:

  • is not a party to that insurance contract;
  • does not act as the Customer’s insurance adviser;
  • does not guarantee that insurance will be available;
  • does not guarantee coverage of any particular event;
  • does not determine whether a claim will be accepted;
  • is not responsible for policy exclusions or deductibles; and
  • is not responsible for an insurer’s claim decision.

The Customer must independently confirm that the chosen policy covers:

  • the country of origin;
  • the destination country;
  • the transport method;
  • the full value of the goods;
  • temporary storage where applicable;
  • owner-packed goods where applicable; and
  • the specific type of personal belongings being transported.

15.4 Customer-Packed Personal Belongings

Where personal belongings have been packed by the Customer, the Customer is responsible for ensuring that the packaging is suitable for the nature of the goods and for the normal risks associated with the selected transport service.

Personal belongings transported by groupage may be subject to:

  • terminal handling;
  • loading and unloading;
  • consolidation;
  • deconsolidation;
  • temporary storage;
  • vehicle transfers; and
  • multiple handling operations.

The packaging must therefore be suitable for such operations.

15.5

Cargo Euro Hub is not required to open or inspect boxes, cases, suitcases, crates or other packages packed and sealed by the Customer.

Such packages may be accepted on the basis of the description and quantity declared by the Customer.

15.6

To the fullest extent permitted by mandatory law, Cargo Euro Hub and MB Baltic Moving Services shall not be responsible for damage insofar as that damage results from:

  • insufficient packaging;
  • unsuitable packaging;
  • weak or overloaded boxes;
  • insufficient internal cushioning;
  • movement of items inside a package;
  • inadequate protection of fragile objects;
  • insufficient protection against scratching or impact;
  • inadequate wrapping of furniture or equipment;
  • items packed together in an unsuitable manner;
  • customer loading or stowage;
  • customer unloading;
  • pre-existing defects; or
  • the inherent nature of the goods.

This provision does not exclude liability where mandatory transport law, including the CMR Convention where applicable, provides otherwise.

15.7 Fragile and Valuable Personal Effects

The Customer must disclose before booking any unusually valuable or fragile articles.

The following should not be included without prior written agreement:

  • jewellery;
  • watches of significant value;
  • cash;
  • securities;
  • precious metals;
  • valuable collections;
  • antiques;
  • fine art;
  • high-value electronics; and
  • other objects of exceptional value.

Acceptance of an item does not create full-value insurance coverage.

15.8 Independent Insurance Resources

For convenience only, Cargo Euro Hub may provide links to independent insurance companies or insurance brokers that offer household-goods or removals insurance.

These links:

  • are informational only;
  • do not constitute an endorsement;
  • do not constitute insurance advice;
  • do not create a partnership between Cargo Euro Hub and the insurer;
  • do not guarantee eligibility; and
  • do not guarantee coverage.

Examples of independent specialist providers include:

Letton Percival – Overseas Removals Insurance
Coverage is primarily intended for eligible shipments moving to or from the United Kingdom.

Baker International Insurance Agency – Household Goods Transit Insurance
Availability and eligibility depend on the Customer, country, route, moving company and policy requirements.

Customers must contact the relevant provider directly and verify eligibility and coverage before transportation begins.


16. Customs, Sanctions and Cross-Border Transport

16.1

For shipments requiring customs formalities, the Customer is responsible for providing complete and accurate information and documentation.

This may include:

  • commercial invoices;
  • packing lists;
  • commodity descriptions;
  • commodity codes;
  • declared values;
  • country of origin;
  • EORI information;
  • import or export licences;
  • proof of ownership; and
  • other documents required by customs authorities.

16.2

Cargo Euro Hub may assist with customs procedures but is not responsible for the accuracy of information supplied by the Customer.

16.3

Customs duties, import VAT, taxes, official inspection costs and similar charges are payable by the Customer or consignee unless expressly included in the quotation.

16.4

Customs clearance time is outside Cargo Euro Hub’s direct control.

No customs-clearance time or border-crossing time is guaranteed.

16.5

Cargo Euro Hub may refuse, suspend or terminate a shipment where performance may breach:

  • European Union sanctions;
  • United Nations sanctions;
  • applicable national sanctions;
  • export-control rules;
  • import restrictions;
  • customs legislation;
  • anti-terrorism measures; or
  • other mandatory legal restrictions.

17. Claims for Loss, Damage or Delay

17.1

The consignee should inspect the shipment at delivery whenever reasonably possible.

17.2

Any visible loss or damage should be recorded on the:

  • CMR consignment note;
  • proof of delivery;
  • delivery receipt; or
  • equivalent carrier document

before the driver leaves.

17.3

Where the CMR Convention applies, claims and reservations are subject to the mandatory CMR requirements.

In particular, concealed loss or damage should be notified in writing within the period prescribed by the CMR Convention.

17.4

A claim should include, where available:

  • Cargo Euro Hub booking or order reference;
  • CMR or transport document;
  • proof of delivery;
  • description of the loss or damage;
  • photographs;
  • commercial invoice or other evidence of value;
  • repair or replacement evidence where relevant;
  • photographs of packaging;
  • photographs of the cargo before transportation where available; and
  • any other information reasonably required to investigate the claim.

17.5

The Customer should retain damaged goods and packaging until the claim has been assessed or until Cargo Euro Hub confirms that they no longer need to be retained.

17.6

For CMR-governed transport, statutory claim and limitation periods under the CMR Convention apply.

Parcel carriers, shipping lines and other transport providers may have different mandatory notification periods, and Customers should notify Cargo Euro Hub of any problem immediately.


18. Undeliverable Goods and Storage

18.1

Where delivery is impossible, Cargo Euro Hub may request further instructions from the Customer or the person entitled to dispose of the goods.

18.2

Where immediate instructions cannot reasonably be obtained, goods may be:

  • unloaded;
  • placed into temporary storage;
  • transferred to a warehouse;
  • returned; or
  • otherwise handled in accordance with applicable transport law.

18.3

Reasonable expenses resulting from non-delivery for reasons not attributable to Cargo Euro Hub may be charged to the Customer.

18.4

Where permitted by applicable law, Cargo Euro Hub may exercise rights of retention or other security rights over goods or documents for unpaid transport and related charges.


19. Force Majeure and Events Outside Reasonable Control

19.1

Cargo Euro Hub shall not be liable beyond the extent required by mandatory law for failure or delay caused by circumstances that could not reasonably be avoided or prevented.

Such circumstances may include:

  • extreme weather;
  • natural disasters;
  • war;
  • terrorism;
  • civil unrest;
  • strikes;
  • border closures;
  • government restrictions;
  • sanctions;
  • epidemics;
  • major infrastructure failures;
  • ferry cancellation;
  • port closure;
  • port congestion;
  • vessel cancellation;
  • road closure;
  • serious accidents;
  • widespread transport disruption; or
  • other comparable events outside reasonable control.

19.2

Where such an event occurs, Cargo Euro Hub may reasonably:

  • change the route;
  • change the carrier;
  • postpone transport;
  • temporarily store the goods;
  • request new instructions; or
  • terminate the affected service where continued performance is impossible.

Additional unavoidable third-party costs may be charged where legally permitted.


20. Electronic Communications

20.1

The Customer agrees that quotations, booking confirmations, transport documents, invoices and other contractual communications may be sent electronically.

20.2

The Customer is responsible for providing a valid email address and monitoring communications relating to the transport.

20.3

Cargo Euro Hub may rely on instructions sent from contact details previously supplied by the Customer unless we have reasonable grounds to believe that the instruction is unauthorised.


21. Data Protection

Personal data is processed in accordance with the Cargo Euro Hub Privacy Policy and applicable data-protection legislation.


22. Applicable Law and Jurisdiction

22.1

These Terms and contractual relations with MB Baltic Moving Services are governed by the laws of the Republic of Lithuania, subject to mandatory provisions of applicable international conventions and other mandatory law.

22.2

For transport governed by the CMR Convention, jurisdiction shall be determined in accordance with the mandatory jurisdiction provisions of the CMR Convention.

22.3

For business Customers, where no mandatory transport-law jurisdiction rule applies, disputes shall be subject to the competent courts of the Republic of Lithuania.

22.4

Where the Customer is a consumer, nothing in this provision deprives the Customer of any mandatory consumer protection or jurisdiction rights available under applicable law.


23. Final Provisions

23.1

If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions shall remain in effect to the extent legally possible.

23.2

Failure by Cargo Euro Hub to enforce a provision on one occasion does not constitute a waiver of that provision.

23.3

Cargo Euro Hub may update these Terms from time to time.

The version applicable to a transport order is normally the version in force when the booking is confirmed, unless mandatory law requires otherwise.

23.4

Headings are provided for convenience and do not affect interpretation.

23.5

In the event of a conflict between a translated version and the English version of these Terms, the English version shall prevail to the extent permitted by applicable law.
